1. Agreement to Terms

By accessing our website at www.awantax.com or engaging the services of Awan Tax & Bookkeeping (“we,” “us,” “our,” or “the Firm”), located at 4821 Quartz Crest St, North Las Vegas, NV 89081, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using our website or hiring our services.

If you do not agree to these Terms, please do not use our website or engage our services.

2. Services Provided

Awan Tax & Bookkeeping provides the following professional services:

  • Personal Tax Return Preparation โ€” Federal and state individual income tax returns
  • Schedule C Small Business Tax Returns โ€” Tax preparation for sole proprietors and self-employed individuals
  • Bookkeeping Services โ€” Monthly financial record keeping, reconciliation, and reporting
  • Virtual / Remote Services โ€” All of the above delivered securely online to clients nationwide

We are a tax preparation and bookkeeping firm. We are not a law firm and do not provide legal advice. We are not a licensed CPA firm unless explicitly stated. Our services do not constitute legal, investment, or financial planning advice.

3. Client Responsibilities

By engaging our services, you agree to:

  • Provide accurate, complete, and truthful information required for your tax return or bookkeeping
  • Supply all necessary documents in a timely manner as requested
  • Review your completed tax return or financial records before signing and authorizing filing
  • Notify us promptly of any changes to your financial situation that may affect your return
  • Keep copies of all tax returns and financial documents provided to you
  • Pay all agreed-upon fees according to the payment terms established at engagement

You understand that the accuracy of your tax return depends on the completeness and accuracy of the information you provide. Awan Tax & Bookkeeping is not liable for errors resulting from incorrect, incomplete, or misleading information supplied by the client.

4. Fees & Payment

Flat-Fee Pricing All services are quoted at a flat fee agreed upon before work begins. You will receive a clear quote prior to us starting any work on your behalf.

Payment Terms

  • Payment is due upon completion of services unless a separate agreement has been made in writing
  • We accept cash, check, and major credit/debit cards
  • For ongoing bookkeeping services, payment is due on the first of each month

Late Payments Accounts past due by more than 30 days may be subject to a late fee. We reserve the right to withhold completed tax returns or financial documents until outstanding balances are paid in full.

Refund Policy

  • If we have not yet begun work on your return or engagement, a full refund will be issued upon written request
  • If work has begun, a partial refund may be issued at our discretion based on work completed
  • Completed and filed tax returns are non-refundable
  • We do not guarantee specific tax refund amounts, and dissatisfaction with a legal tax outcome does not constitute grounds for a refund

5. Accuracy & Limitation of Liability

We prepare your tax return based solely on the information and documents you provide. While we exercise professional care and diligence in our work:

  • We are not responsible for errors, omissions, or penalties resulting from inaccurate or incomplete information provided by the client
  • We are not responsible for IRS audits, penalties, or interest that result from information the client failed to disclose
  • Our total liability to any client for any claim arising out of or related to our services shall not exceed the total fees paid by the client for the specific service in question
  • We are not liable for any indirect, incidental, or consequential damages of any kind

6. IRS Circular 230 Disclosure

Pursuant to IRS Circular 230, any federal tax advice contained in this communication, including attachments and enclosures, is not intended or written to be used, and cannot be used, by any taxpayer for the purpose of avoiding penalties that may be imposed by the Internal Revenue Service.

7. Confidentiality

We treat all client information as strictly confidential. We will not disclose your personal or financial information to any third party except:

  • As required by law or valid legal process
  • With your explicit written consent
  • To the IRS or relevant tax authorities as necessary to complete your filing
  • To trusted service providers bound by confidentiality agreements who assist in delivering our services

8. Document Retention & Return

  • We retain copies of completed tax returns and supporting documents for a minimum of 7 years in accordance with IRS guidelines
  • Original documents provided by clients will be returned upon request
  • Electronic copies of your completed return will be provided to you at no additional charge
  • After the applicable retention period, documents will be securely destroyed

9. Electronic Communications & E-Signatures

By using our virtual services or communicating with us electronically, you agree that:

  • Electronic communications via email and our secure client portal constitute valid written communications
  • E-signatures applied through our approved electronic signature platform are legally binding and equivalent to handwritten signatures
  • You consent to receive service-related communications electronically

10. Third-Party Software & Portals

We may use third-party software platforms for document management, tax preparation, and communication. These platforms have their own terms of service and privacy policies. By using our services, you acknowledge and agree that your information may be processed through these platforms solely for the purpose of delivering our services.

11. Website Use

By using our website, you agree to the following:

  • You will not use the website for any unlawful purpose
  • You will not attempt to gain unauthorized access to any part of the website or our systems
  • You will not transmit any harmful, offensive, or disruptive content
  • You understand that website content is provided for informational purposes only and does not constitute professional tax, legal, or financial advice
  • We reserve the right to modify, suspend, or discontinue the website at any time without notice

  • We reserve the right to decline or discontinue services to any client at any time

14. Dispute Resolution

In the event of a dispute arising from these Terms or our services, both parties agree to first attempt resolution through good-faith communication. If a resolution cannot be reached informally, disputes shall be resolved through binding arbitration in the State of Nevada in accordance with applicable arbitration rules, rather than through court litigation.

Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Clark County, Nevada.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
